This privacy policy ("Privacy Policy") explains how we collect, use and share information when you use our mobile application ("App"), website(s) and/or Services (hereinafter referred to as "Platform"). Any references to "you", "your" or "User" shall mean any person or entity using, accessing or enrolling with our Platform. We will not use or share your information with anyone except as described in this Privacy Policy.
This Privacy Policy sets out our personal information collection and sharing practices for our Platform and through the other channels described below. By using or accessing our Platform, you agree to the collection, use and disclosure of information in accordance with this Privacy Policy. Notwithstanding anything to the contrary stated elsewhere, for users of the Platform, this Privacy Policy would be applicable.

We respect your right to privacy and will only process personal information about you or provided by you in accordance with the "Data Protection Legislation" which for the purposes of this Privacy Policy shall mean: (i) the Digital Personal Data Protection Act, 2023 read with the rules made thereunder ("DPDP Act"); and (ii) Information Technology Act, 2000 read with the rules made thereunder, as may be amended and modified from time to time ("IT Act"); or (iii) any successor legislation to the foregoing legislations and other applicable privacy laws. By using the Platform, you consent to the practices described herein.
Capitalised terms used here but not defined shall have the same meaning as ascribed to them in the Terms unless the context otherwise requires. All the parts of the Policies are to be construed harmoniously. However, in case of a conflict between the Terms and this Privacy Policy, this Privacy Policy shall prevail on all matters related to data collection, processing and matters related thereto. For all other conflicts in any part of the Policies, the Terms shall prevail.

If the scope of the Services availed by the User includes medical insurance through an Onboarded Entity, we may be constrained to collect additional information as a data processor. We do not collect or store sensitive biometric data or financial documents.
In order to gain insights into user interactions and enhance the functionality of our Platform, and for improving the Initiative for the benefit of our User-Beneficiaries, we may collect various types of Usage Data. This includes log files, IP addresses, device information, device location, and browsing activity. By gathering this information, we aim to gain a better understanding of how users engage with the Platform, identify areas for improvement, and optimize its performance. The analysis of Usage Data allows us to enhance the user experience, tailor features to specific user preferences, and ensure the Platform meets the evolving needs of our users. The collection of this data is conducted in accordance with Data Protection Legislation, and all necessary measures are taken to safeguard the confidentiality and security of the collected information.
We might receive information about you from other sources, such as any information uploaded by you on the Platform, information from any personal correspondence received by us, etc. We only collect anonymised data from the Onboarded Entities for the limited purposes of improving the Initiative for the benefit of our Beneficiaries.
We only collect information about you if we have a reason to do so — for example, to register, check your eligibility and issue the Health Saathi Membership Card, share healthcare event information and reminders, provide emergency support features (like blood donor help), for improving the Initiative for the benefit of our User-Beneficiaries, to communicate with you, or to make our Services better for you. We process your information for legitimate business needs, the fulfilment of our contract with you, compliance with our legal obligations, and/or your specific consent.
The Personal Data we collect is utilized to facilitate seamless Services and communication between you and us. This includes providing essential features such as call options and relevant information, enabling Users to efficiently connect and interact with us. Additionally, we employ this Personal Data to maintain and track our Platform. By utilizing personal information in this manner, we aim to streamline the user experience, foster productive relationship with you, and enhance the overall functionality of the Platform. We treat all Personal Data with the utmost care and in compliance with Data Protection Legislation, taking appropriate measures to protect its confidentiality and security.
At your option, you can provide testimonials and feedback for the Services. However, please note by providing your testimonial and feedback, you are consenting that your Personal Data such as name, picture, and other information as may be contained in the testimonial/feedback can be used for advertisements for our Services.
To continuously enhance the performance and functionality of our Platform, we conduct comprehensive analysis of Usage Data. This analysis serves multiple purposes, including improving the overall performance of the Platform, enriching the quality of data, enhancing the user experience, and optimizing our Services for the benefit of the User-Beneficiaries and for research purposes. We might use your Data Usage patterns and information collected from your usage to keep our Platform safe and secure by involving technologies related to fraud monitoring and prevention. Apart from this, it may be used to protect our Platform or for legal reasons if a legal request is placed on us.
We only share information with your consent, to comply with laws, to protect your rights, or to fulfil business obligations.
We may share your Personal Data with Onboarded Entities strictly for facilitating you and the relevant Onboarded Entity in relation to the Benefits and the Health Saathi Membership Card. This sharing of information is essential for the seamless operation and optimal Services to you. This sharing also helps to create an environment conducive to efficient and effective Platform utilization, enabling smooth Services and enhancing user experiences.
As part of our commitment to continuous improvement and enhancing our Services, we may share aggregated and anonymized usage data with our trusted partners for analytics and statistical purposes. It is important to note that in this process, any Personal Data associated with the aggregated data is carefully anonymized to ensure individual identities cannot be discerned. However, it is important to emphasize that your Personal Data is not shared with our partners for any other purposes, and all data is handled in compliance with applicable privacy laws and regulations.
We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal processes, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements).
As we continue to develop, we might transfer the Health Saathi Initiative along with all its assets and the Services to a third party which would be entrusted for facilitation of the Initiative and for better Services. If such transfer takes place, User information generally is one of the transferred assets. However, Personal Data shall continue to be subject to the Privacy Policy.
We aim to protect your Personal Data through a system of organizational and technical security measures. We have implemented appropriate technical and organizational security measures designed to protect the security of any Personal Data we process. However, please also remember that we cannot guarantee that the internet itself is 100% secure. Although we will do our best to protect your Personal Data, the transmission of Personal Data to and from our Platforms is at your own risk. You should only access the Services within a secure environment.
We will only keep your Personal Data for as long as it is necessary for the purposes set out in this Privacy Policy unless a more extended retention period is required by law (such as tax, accounting or other legal requirements). Subject to applicable law, according to us no purpose in this Privacy Policy will require us to keep your Personal Data for longer than 3 (three) years. When we have no ongoing legitimate business need to process your Personal Data, we will either delete or anonymize it, or, if this is not possible (for example, because your Personal Data has been stored in backup archives), then we will securely store your Personal Data and isolate it from any further processing until deletion is possible.
In addition, we provide you with the right (i) to request a copy of your Personal Data available with us, (ii) to request rectification or erasure of your Personal Data; (iii) to restrict the processing of your Personal Data and (iv) to nominate a person to exercise these rights in the unfortunate event of your death or incapacity. Withdrawal of Consent Procedure: You can opt out from collection or use of any Personal Data by our Platform. To withdraw consent for collection and usage of Personal Data, please email unsubscribe to support.healthsaathi@aimym.org. You have the right to withdraw your consent at any time. Please note however that this will not affect the lawfulness of the processing before its withdrawal. Also, such withdrawal may not be possible if you choose to continue availing our Services in particular or the Platform.
We try to answer every request promptly wherever possible, and provide our response within the time period stated by applicable law. However, please keep in mind that when deleting your Personal Data there may be residual information that will remain within our databases, access logs, and other records, which may or may not contain your Personal Data. Please also note that certain Personal Data may be exempt from such requests in certain circumstances, which may include if we need to retain your Personal Data to comply with a legal obligation. When you email us with a request, we may ask that you provide us with information necessary to confirm your identity.

There is no specific app that we have tagged within our system but given the common practices, Zoho/Google Mail/Zoom is mostly used. Their terms of service and privacy policies can be referred at their respective websites. Again, this is subjective to the websites you engage with for different activities. If you click on one of the links to third party websites, you may be taken to websites we do not control. This Privacy Policy does not apply to the privacy practices of those websites. We will use our best efforts to negotiate in good faith and settle any dispute that may arise out of or relate to this Privacy Policy or any breach of it, and any escalating dispute or claim relating to or connected with it (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of India and the courts of New Delhi, India are the only place where disputes or claims relating to or connected with this Privacy Policy (including non-contractual disputes or claims) may be decided.
