1. Introduction

All India Marwari Yuva Manch ("AIMYM") is a duly registered not-for profit [public trust] in India having its registered office at New Delhi, India, (hereinafter referred to as "we," "us", "AIMYM" or "our"). AIMYM has been created for charitable purposes. It functions and services the community through its branches across India primarily from donations, which are largely from the Marwari community. Through Health Saathi, our health services facilitation initiative ("Initiative") we, inter alia, intent to help the beneficiaries of the Initiative ("Beneficiaries") to avail health care services from the onboarded third party health care services providers ("Onboarded Entity") at discounted rates and also avail certain other additional benefits (together the "Benefits") (our "Services").

These Terms & Conditions ("Terms") govern the use of our Health Saathi mobile application ("App"), website(s) and/or Services (hereinafter referred to as ("Platform"). Any references to "you", "your" or "User" shall mean any person or entity using, accessing or enrolling with the Platform. We will not use or share your information with anyone except as described in the Privacy Policy.

Health Saathi is a health and wellness facilitation platform operated by Akhil Bharatiya Marwari Yuva Manch (ABMYM), a voluntary youth organization headquartered at Delhi, India. Our goal is to facilitate affordable, quality healthcare services through association with Hospitals, Diagnostic Centers, Path Labs, Pharmacies etc. for its members and their family members.

By accessing or using the Platform, you agree to be bound by our policies including these Terms, the Privacy Policy, Refund Policy, Grievances Policy, and all disclaimers and indemnity clauses which may be published on the Site from time to time or communicated to you separately (together "Policies"). If you do not agree with any part of these Policies, please do not use the Platform.

2. Eligibility

By registering for the Initiative, you confirm that:

• you are 18 years or above, of a sound mind and otherwise competent to contract as per laws of India;
• all the information you provide is accurate, current, truthful, complete and you shall be solely responsible for any consequences of incorrect or incomplete information.

Please note, membership plans are governed by our community and referral-based structure, and we reserve the right to verify user identity without any obligation to do so and reject or terminate membership based on community or referral-based eligibility requirements.

3. Use of the Platform

By using the Platform, you agree to:

• Use the Services only for lawful purposes at your own risk;
• Verify availability of Benefits before availing any health care services from an Onboarded Entity;
• Present the digital health card or any other registration credentials for the Initiative's membership ("Health Saathi Membership") that may have been provided to you as a mark of registration ("Health Saathi Membership Card") with the Initiative, while availing the Benefits at the Onboarded Entity at all times and present the same when requested for;
• Not misrepresent yourself or others;
• Not interfere with the Platform's security or functionality;
• Do not collect data or information from other users without consent and/or prior written approval of AIMYM;
• Use the Platform in accordance with the Policies and all applicable laws;
• Not upload or transmit viruses, malware, or harmful code. And also not use automated scripts or scraping technologies without our prior written authorization.

4. Membership and Subscriptions

Your use of the Health Saathi Membership Card / Benefits is subject to:

• Completion of registration and donation (as/if applicable) which is non-refundable unless expressly stated;
• Adherence to the validity period of your selected membership tier;
• Non-transferability of membership benefits;
• Compliance with applicable law;
• Compliance with any referral verification requirements.

We reserve the right to suspend or cancel membership/Health Saathi Membership Cards in case of misuse or violation of terms at its sole discretion.

5. Services and Limitations

• Health Saathi is purely a facilitation platform being provided on a best-efforts basis by us. We are acting solely as a connecter in good faith and not a medical services provider.
• We connect members with independent third-party service providers (hospitals, diagnostics, pharmacies, and insurers) over whom AIMYM have no control whatsoever.
• We do not guarantee or warrant the quality, accuracy, or efficacy of the services of the Onboarded Entities, their pricing, discounts, or availability of third-party providers in any way.

Any medical decision or emergency service must be taken entirely at the user's discretion and risk in consultation with qualified professionals only.

We do not provide medical advice, diagnosis, or treatment nor are equipped to do so. All health-related services are provided by third-party professionals or entities.

Always consult a qualified healthcare provider before making any medical decisions.

6. Partner Services

• Discounts and benefits are offered through independent third-party service providers, that is Onboarded Entities. Such discounts or benefits offered by them are at their discretion and may be changed, altered or stopped at any time without notice.
• Health Saathi is not liable for the Onboarded Entities in any way, directly or indirectly, including for the negligence, acts, omissions, or representations of the Onboarded Entities, including their service outcomes, discount denials, delays, or disputes.
• Users must confirm the terms of service directly with Onboarded Entities before availing their services.
• Health Saathi does not endorse, guarantee, or warrant the services of any third-party provider including of Onboarded Entities.
• Users are solely responsible for verifying and shall avail services entirely at their own risk the credentials, terms, and quality of service before availing any Benefits.

7. Privacy and Data

Your personal data is handled in accordance with our Privacy Policy.

By using Health Saathi, you agree to the collection, processing, and sharing of your data as outlined in our Privacy Policy.

You have the right to withdraw consent, request correction, or request deletion of your data, subject to legal and operational considerations.

8. Payments and Refunds

• Donations and fee for our Services are processed via secure third-party gateways.
• Refunds, if applicable, are governed by our Refund Policy.

• We are not responsible for payment failures or any consequential losses arising therefrom due to banking errors, internet disruption, or third-party gateway issues.

9. Intellectual Property

All content on the Platform, including but not limited to trademarks, service marks, software, designs, and data compilations, is the property of AIMYM or its partners. These are protected under applicable laws of India. You shall not copy, modify, distribute, or exploit any content without express written permission.

10. Termination of Access

AIMYM reserves the right to suspend or terminate your Health Saathi Membership Card/Benefits if:

• You violate the Policies;
• Engage in fraudulent, harmful, or abusive conduct;
• Tamper with our system or partner relationships;
• Fail to meet eligibility or referral guidelines.

11. Limitation of Liability and Indemnity

Health Saathi is not liable whether in contract, tort, negligence, strict liability, or otherwise for any direct, indirect, incidental, or consequential damages from use of the Platform or for any reason connected with a third-party/Onboarded Entity. However, if we are called upon to pay damages, the amount shall not exceed the amount paid by you to us for availing the Health Saathi Membership Card.

All our Services are offered on an "as-is" and "as-available" basis without warranties of any kind.

We do not guarantee uninterrupted or error-free access to the Platform.

Users agree to indemnify, defend, and hold harmless AIMYM, its trustees, office bearers, volunteers, affiliates, and representatives from any claims, losses, damages, liabilities, costs, or legal expenses arising from use of the Platform or third-party services.

12. Amendments

We may update these Terms from time to time. Any changes will be notified via app/website or email or any other mode deemed fit. We encourage you to review these Terms frequently to be informed of amendments/modifications (if any). Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of the Initiative are subject to the exclusive jurisdiction of the courts of New Delhi.
